These Terms of Service (“Terms”) govern your access to and use of the Up & Under platform operated by Up and Under Fantasy Sports (Pty) Ltd (“we”, “us”, “our”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
You must be at least 18 years old and a resident of South Africa to use Up & Under. By using the service you represent that you meet these requirements.
2. Free-to-play, XP-only service
Up & Under is a free-to-play prediction platform. All slips are settled in experience points (“XP”). XP has no monetary value, cannot be exchanged for cash, goods, services, or any other form of consideration, and does not constitute gambling under South African law. We do not accept deposits, operate wallets, or conduct real-money wagering.
3. Accounts
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
One account per person. Creating multiple accounts, using another person's credentials, or using automation to manipulate outcomes is grounds for immediate termination.
4. Fair play
You agree not to: (a) use the service for any unlawful purpose; (b) attempt to manipulate player stats, settlements, or the leaderboard; (c) reverse-engineer, scrape, or interfere with the service; (d) harass other users.
5. Intellectual property
The Up & Under platform, brand, and all original content are owned by us or our licensors. Rugby fixture and player data is licensed from third-party providers and remains their property.
6. Service availability
The service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access and may suspend, modify, or discontinue the service at any time. Where possible we will give reasonable notice before material changes.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to ZAR 500.
8. Termination
We may suspend or terminate your account if you breach these Terms or engage in conduct that harms the platform or other users. You may delete your account at any time via your profile settings.
9. Governing law
These Terms are governed by the laws of the Republic of South Africa. Disputes will be resolved in the courts of South Africa.
10. Changes
We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before taking effect.
